This can be done during the time that they are being hired. While they sign the contract, the contract should clearly explain that the employees may be laid off incase there is need to do so without discrimination.

A company’s success largely depend on the increasingly on the diverse knowledge, background, skills, motivation and creativity of its employees. Pacific Gas & Electricity Company should therefore make it clear to its employees that one of its objectives is to realize growth and to do this, it has to consider its employees performance and value and this is the reason why it is conducting this program. The company should therefore make it clear to the laid of employees that it has not been discriminatory that they are laid of but it is according to the recommendations that are set in the program. (Balking, D. et al, 2001)

In addition, before the employees are laid off, the company should make a point of contacting them in individually and inform them of the plan and they will be laid off in a specific period of time and therefore they are free to look for another job. At the same time, the company should give these employees all the benefits that they are entitled to once they are laid off. This would prevent them from complaining that they have been discriminated.
